Tend terms of use

Effective and last updated October 13, 2026.

Tend is a game for adults in the United States. Your pet grows when you exercise: cardio, training, and, if you choose, weighing in. These terms are the agreement between you and Hayden Rickard, who makes Tend ("we", "us"). Please read them. They're written to be read.

1. Agreeing to these terms

When you make your account, or when the app asks you to agree after these terms change, you agree to these terms and to our privacy policy and consumer health data privacy policy, which say how we handle your data. The health notice is part of these terms. If you don't agree, don't use Tend.

Your health data is separate. Before Tend reads any of it, the app asks three things, each its own choice: your OK to use it, which is needed to play; whether friends may see your activity, which is up to you and off unless you turn it on; and whether to help improve Tend with usage counts and crash reports, also up to you and off unless you turn it on. You can change any of them anytime in Settings, then Your privacy.

2. You must be 18 or older

Tend is only for adults 18 and over who live in the United States. By using it, you tell us you are. If we learn an account belongs to someone under 18, we close it and delete its data.

3. Tend is a game, not medical advice

Tend counts what you do and gives a pet a reason to care. It isn't medical advice, a diagnosis, a treatment, or a substitute for a doctor. It doesn't know your health, and its goals, suggestions, paces, food numbers and heart-rate zones are general and may not be right for you. Numbers from Apple Health, your phone, your watch or a food database can be wrong.

Talk to a doctor before you start exercising, change how hard you exercise, or try to lose or gain weight, especially if you're pregnant, have a heart, lung, joint or other condition, take medication that affects your heart rate, or have or have had an eating disorder. If you feel pain, dizziness, chest pain or shortness of breath, stop and get medical help. In an emergency, call 911.

4. Exercise is at your own risk

Exercise has risks, including injury, and in rare cases serious injury or death. You choose whether, when, where and how hard to exercise, and you're responsible for doing it safely: know your limits, watch where you're going, obey traffic laws, don't look at your phone while you're moving, and don't exercise anywhere or in any way that's unsafe. To the extent the law allows, you take on those risks yourself. Nothing in Tend is worth an unsafe step.

5. Your account

You need an account to play, made with your email or with Sign in with Apple or Google. Give true information, keep your password to yourself, and tell us if you think someone else is using your account. You're responsible for what happens on it. One person, one account. You can delete your account anytime in Settings. It's removed from our server right away, and from the server's backups within 30 days. There's no undo.

6. How to behave

Tend has friends, chat, cheers, nudges, gifts, room visits and shared goals. Chat is only between friends, and it's made of emotes and lines we wrote, so there's nothing to type. The names you pick (your username, the name friends see, and your pet's name) are yours, though, and the person on the other end is a real person. There's no tolerance for objectionable content or abusive users. Don't:

In a chat, tap the menu and choose Report to send us a message, or Block to stop someone reaching you. You can also report from a profile. We look at reports within 24 hours and remove content that breaks these rules. Reports are kept for 90 days, for safety review. We can warn, suspend or close accounts that break them, without notice when someone is being hurt.

What you name and send stays yours. You give us permission to store it, show it to the people you send it to or who can see your profile, and review it when it's reported, only to run Tend.

7. Honest numbers

Your pet is a record of your own days, so faking an entry only cheats you. We may remove obviously fake activity from standings and shared features, and close accounts that fake it again and again.

8. Tend+ and purchases

9. Treats, looks and the pet

Treats are what you earn by exercising and spend in the game's shop. There are no coins, and nothing in Tend is money: treats can't be bought with real money, and there are no money goals. Treats, tricks, looks, outfits and their colors, rooms, keepsakes and the pet are part of the game. They have no cash value, can't be sold, traded or transferred, and can't be exchanged for money. You get a personal permission to use them in Tend while your account is open, and they end when it does.

10. Our app, and your permission to use it

Tend, its art, sounds, words and code belong to us or the people who license them to us. We give you a personal, non-exclusive, non-transferable, revocable permission to use Tend on Apple devices you own or control, for your own non-commercial use, under these terms and Apple's rules.

11. Apple

You get Tend from Apple, on the App Store, so Apple's Standard License Agreement applies to your use of the app along with these terms (where they differ, these terms apply, except where Apple's rules say otherwise). These terms are between you and us, not Apple. Apple isn't responsible for Tend or its content, has no duty to provide maintenance or support for it, and, to the extent the law allows, has no other warranty obligation; if Tend doesn't match any warranty that applies, you can tell Apple and Apple will refund the price you paid for the app, if any. Apple isn't responsible for any claims about Tend, including product liability claims, claims that it doesn't meet a legal or regulatory requirement, consumer protection or privacy claims, or claims that it infringes someone's intellectual property; we are, as these terms say. You confirm you're not in a country under a US government embargo or on a US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.

12. No warranties

Tend is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that Tend will always work, be free of bugs, read your health data correctly, count every step, or never lose anything. A backup is not a guarantee.

13. Limits on what we owe you

To the extent the law allows, we're not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, a lost streak, a pet that falls asleep, lost time, or any injury or health problem from exercise or diet choices you make while using Tend. Where we are liable, our total liability is limited to the greater of $50 or what you paid us for Tend in the 12 months before the claim. Some states don't allow some of these limits, so they may not all apply to you. Nothing here limits liability that the law doesn't let us limit, like for fraud or gross negligence.

14. If a claim comes from your use

To the extent the law allows, you agree to defend and hold us harmless from claims, losses and costs (including reasonable legal fees) that come from your breaking these terms, your misuse of Tend, or what you send to other players.

15. Ending things

You can stop using Tend and delete your account anytime. We can suspend or close your account if you break these terms, if the law requires it, or to protect other players. We can also change, pause or end Tend or any part of it. If we end Tend+ while you have a paid subscription, we'll tell you in the app so you can cancel before the next charge. Sections 3, 4, 9 and 12 through 18 keep applying after your account closes.

16. Governing law

These terms are governed by the laws of the Commonwealth of Kentucky and the federal laws of the United States, without regard to conflict-of-law rules. Where the law of the state you live in gives you rights that can't be taken away, those rights still apply.

17. Settling disputes

Talk to us first. If you have a problem with Tend, email us at support@playtend.app and tell us what's wrong. We'll try to sort it out with you within 30 days. Most problems get solved this way.

Courts. If we can't, the dispute goes to the state or federal courts in Kentucky, and you and we agree those courts can hear it. Where the law of the state you live in lets you bring a claim in your own state's courts, you still can.

Small claims. Either of us can always bring a claim in small claims court instead, if it qualifies.

Nothing in this section stops you from telling a government agency, like the Federal Trade Commission or your state attorney general, about a problem.

18. Changes to these terms

We may update these terms as Tend changes. The date at the top says when. If a change matters, the app shows you what changed and asks you to agree before you keep playing. If you don't agree, you can't keep playing, but you can still download your data and delete your account in the app. Changes never apply to a dispute we already know about.

19. The rest

These terms, with the policies and notice they link to, are the whole agreement between you and us about Tend. If a part of them can't be enforced, the rest still stands. If we don't enforce something right away, we haven't given it up. You can't transfer these terms to someone else; we can transfer them if Tend changes hands.

20. Contact

Questions, reports, notices, or anything else: Hayden Rickard, support@playtend.app, or Contact us in the app's Settings.
